They also made an awsome come back to make it to the playoffs, then they beat out the Pitsburg Pirates so the can play the St. Louis Cardnials in the finals. If you wanna find out how they did your just going to have to read on. He doesn't want his players to be drinking anything during the season. If he catches them there in for it deep. The coach will fine the players the first time their caught with fifty dollars. The second time they get suspended and a hundred dollar fine. The third time..well there isn't a third time. When the coach made this statement at the end of a game in the locker room, the most mouthy person on the team even knew that he meant it because Raz didn't say a thing. The coach has also almost caught many people on the team but they get extremely lucky and get away with it. The players think that alcohol is the answer to all the stress after the game. Yet the coach knows that it will only get the players sick and he is only doing this so that the players stay safe for the games. Bones was fined once for alcohol and it wasn't to much his fault. It was because of his roomie who took him out and got him drunk because he thought he was to stressed out. Spike made an example out of Bones an d they moved Bones with another room mate. Bones Hathaway was now stuck with an old veteran pitcher and he didn't like it. Mr. MacManus who owned the team was going to suspend Bones Hathaway because Spike was being a hot head. He kept screwing thing up and Mr. MacManus was going to take it out on his team. Luckely Spikes brother Bob was there and cooled Mr. macmanus' temper. The Dodgers have been playing tons of games just so they can win the pentane. All they want is the pentant. They even play games from like ten o'clock at night and can go on till two a.m. The Cardinals are in first, Pirates in second, and the Dodgers in third. They have beaten the Cardinals before but not enough times to move ranks around. They want to face the Cardinals in the World Series for the pentane because they are pretty sure that they can beat them. The Dodgers were actually on a winning streak at one point then their best rookie pitcher became sick. He was one of the reasons they had a winning streak but on the first day they won he had bacon, eggs, and toast. The next game he ate the same breakfast and they won again. So he was being superstitious and ate that breakfast for eleven days straight. The coach gave a long speach about them eating right and he was very upset that his best rookie pitcher was sick. Spike had a talk with Bones Hathaway after he got better and aske d him some question. He wanted to make sure that Bones wasn't getting sick because the other team paid him and that Bones was a good hitter but didn't show it because the other team paid him. The last game. Only one game was left for those courageous Brooklyn Dodgers. They made it. They made it all they to the pentane game. It was just them and the St. Louis Cardinals. The conventions governing ministerial responsibility Essays The conventions governing ministerial responsibility Paper The conventions governing ministerial responsibility Paper Essay Topic: Law As we have learnt from out study of conventions, it would be very difficult to track down every convention relevant to ministerial responsibility, as they can be found from a variety of sources, some of which are unwritten. I shall be attempting to examine the most significant conventions, and examining their nature to determine exactly how effective they are. In particular, I shall look at the nature of convention itself to establish criteria on which we can judge the scope and adequacy of the conventions. I shall also examine incompetence and impropriety throughout ministerial departments and the civil service, because as we shall discover shortly, ministers are accountable for more than just their own actions. Conventions are the rules which regulate the day-to-day functioning of the legal constitution, described by some as the rules of constitutional morality. The most important conventions in the constitution are commonly regarded as those which either limit monarchical power or, as is applicable here, regulate the relationship between government and Parliament. The nature of convention is such that some may be well-established and clear, like that which ensures that Parliament meets at least once a year, whereas others are less clear and tend to cause controversy. For a convention to be properly established, it needs to be accepted by those whom it affects. However, a convention is not directly enforceable by law, which is where matters of inadequacy play a part, as we shall discover later on. Ministers are members or supporters of the party in power which holds political office, who often have departmental responsibilities for which they are politically responsible to Parliament as individuals. Ministers are thus responsible for their own actions, a concept known as individual responsibility, and are accountable for the actions of their department, and I shall discuss the distinction between the two later on. Ministerial responsibility has been the accepted basis of parliamentary government in Britain since the mid-19th century, along with particular development in the other main aspect of ministerial responsibility collective responsibility. This is the idea that ministers must hold a united front once a cabinet decision has been made, having been given the chance to dissent or resign when the decision itself was being made. It is necessary to outline some of the governmental conventions used regarding ministerial responsibility. The Ministerial Code created in 1945 is the primary source for most of these conventions, which were revised and reissued by Blair in 1997. The principles of ministerial conduct stated in this code include a duty to uphold collective responsibility and a requirement for ministers to account for the activities of their department/agency. More specifically, the code also states that, ministers who knowingly mislead Parliament will be expected to offer their resignation to the Prime Minister, and the word knowingly is of particular significance. Ministers have a duty to be as open as possible with Parliament and the public, refusing information only when disclosure would not be in the public interest. A minister must behave according to the highest standards of constitutional and personal conduct in the performance of their duties. The Carltona Principle also states that if a decision is made on behalf of one of his officials, then that constitutionally is the ministers decision. It is also a duty of a minister to send civil servants under him to select committees for questioning, if they are called upon. However, in most cases, civil servants are not responsible for their actions and decisions, unless powers have been formally delegated from a minister. Despite the apparently clear nature of these conventions, the system of ministerial responsibility has been shown by many to be an insufficient means of scrutinising government, and ways of breaking these conventions, or amending them to suit circumstances have exposed their uncertainty and inadequacy. If we examine some of the conventions that I listed, we can show how each of them has failed in their duty to govern ministerial responsibility. I outlined that ministers have a duty to account for their departments, but there is a growing accountability gap which is allowing ministers to distance themselves from the traditional full accountability for their department. Prison difficulties in 1995 exposed this issue, when the chief executive of the Prison Service was dismissed following review of prison security, which showed problems traceable to the prison service headquarters. The Home Secretary, Michael Howard denied that any policy of his caused the problems, and refused to take responsibility for his agencys failures. The fact that a minister actually has the freedom to do this exposes the clear inadequacy of the convention in safeguarding against ministerial impropriety, which saw a member of the civil service take responsibility for the issue without much political tumult from the rest of the government. Even if Howard wasnt at fault, the convention has no means of testing or ensuring that, nor of actively stopping a minister from relinquishing responsibility for a departmental error. The Scott Report 1996 is full of examples of ministers deliberately holding back information, refusing to answer questions and providing inadequate responses to questions. The whole arms to Iraq issue exposed problems within the conventions of ministerial responsibility, particularly in defining who was accountable, and in extracting necessary information from officials. It can be argued that those ministers who did not account for their actions for reasons of commercial confidentiality, or in the public interest, were not fulfilling their ministerial duty, particularly in knowingly misleading Parliament. Scott specifically stated that British Governments act as though they are the state, and regularly confuse the public interest with their own governmental convenience. Even though the government narrowly avoided being implicated for a cover-up by surviving a parliamentary debate by one vote, convention was shown to insufficiently prevent ministerial misconduct. I find that the usage of the confidentiality excuse was particularly barren, as it contradicted UK policy to publish details of certain arms exports in the UN Arms Register, itself an initiative of John Major. As Lewis and Longley identify, there was no reason why the ministers could not have at least provided details regarding the nature and quantity of arms involved, even if commercial confidentiality had to be maintained. In general, conventions regarding avoidance of answering questions are completely deficient in preventing the avoidance of politically fragile issues out of convenience. The democratic process is totally undermined by the inability to scrutinise government, and prevent such indirectness. Another issue brought up by the report was the prevention of the select committee from questioning key civil servants who had retired. These civil servants would have provided valuable information to the inquiry, but convention held that they could not be questioned. Inadequate safeguarding against ministerial errors is yet again exposed, as this convention acts as yet another means of shielding ministers (and departments) from taking responsibility for their actions. On the whole, the Scott Report exposed a general assumption of executive dominance over Parliament, prioritising government policy over law, and depicting the conventions as open to discretion and highly ambiguous. It is outlined in convention that ministers should maintain the highest standards of constitutional and personal conduct, yet the nature of ministerial responsibility has been shown to be such that the upholding of this convention is also unnecessary. The government almost always backs any minister that is facing an enquiry, using its majority in the House of Commons, if opposition attempts to table a motion of censure to try and employ some means of governmental scrutiny. Thus another convention is shown to be empty and easy to bypass by government shielding of its own. I have discussed the inadequacy of these conventions in some depth, but further examination of the uncertainty of the scope of some of these conventions is also required. I outlined a duty to uphold collective responsibility. However, from examples such as dissent regarding implementation of a 10% tariff in the economic crisis of 1932, and the unwillingness to continue membership of the European Communities in 1974, an alternative option was given to ministers whereby it was not necessary for ministers to resign, known as agreement to differ. In the first example, the option for completely open dissent was given, but in the second example, only dissent outside of Parliament was permitted. It appears from these examples that departure from convention governing ministerial responsibility is permissible when it suits the Cabinet, undermining the nature of the convention itself. Also, as outward cabinet unity (regarded by many as the main reason for collective responsibility) has been sacrificed in any case by allowing open dissent, why should different levels of outward dissent be permitted in different circumstances? The scope of convention is shown to be uncertain here, as well as the extent to which the convention should apply, and when agreement to differ, should be permitted. The whole responsibility vs. ccountability debate shows further uncertainty as to how far convention actually applies. Theoretically, a minister is accountable for all that happens in his department, but my example of the Home Secretary in 1995 showed weakness in this convention. The real problems arise when there is genuine uncertainty as to who is responsible for a policy. The uncertain nature of this convention allows a minister to avoid taking responsibility for a decision made in his department, but similarly, a civil servant can also avoid this responsibility, as he isnt expected to know enough to make sufficiently educated decisions. There is also continuing debate regarding how far a minister is responsible for maladministration of power if a civil servant below him makes a mistake, and the circumstances in which a minister should have to resign. Clearly convention does not hold the answer to these questions, as the answers depend on the political atmosphere in which the issue has occurred, so convention can be shown to be uncertain in providing safeguards against relinquishment of ministerial responsibilities. I have based my argument on criticism of the conventions governing ministerial responsibility. However, there are aspects of convention which could be called creditable, and show why the system of convention has lasted so long. One good thing about this system is that it has allowed power to theoretically remain in the hands of the electorate, so that ministers can share out policy-making and administrative authority, rather than having it concentrated in the hands of the monarch. This in turn makes it relatively easier to scrutinise these spread powers. Although the idea of absolute control of political behaviour through collective responsibility is debatably a dangerous idea, it also has positive aspects in showing the party to be uniform in policy and ideas, working together for the good of the people, and also helps to contain public disagreement between departments, which would otherwise present the view of a dysfunctional government. Also, when I discussed the nature of agreement to differ, although my point was that it contravened convention, I do believe that the actual concept itself is positive, and should be more clearly incorporated into the convention itself. I have emphasised throughout the essay that the civil service are able to avoid taking responsibility for many of their actions, but ministers do have the power to dismiss civil servants for maladministration or other major errors, so they are not completely free from responsibility. The courts can also get involved in issues of ministerial responsibility where necessary, although their power is limited to compensation and other similar judgements, rather than amendments to problems cemented by the nature of ministerial responsibility. I must also stress that in criticising the conventions governing ministerial responsibility, I am not necessarily discrediting the convention system as a whole; rather I am identifying that the current conventions that we have are vague, uncertain and inadequate at preventing ministerial incompetence and impropriety. It must still be noted that conventions remain an effective way of keeping the constitution up to date regarding contemporary political values. I also commented on how convention is not actually legally enforceable. However, as Dicey argues, breaking of many conventions can in fact still lead to involvement of the courts, as convention and law in our constitution are so intertwined that breaking one will very often require breaking of the other. In a survey, Mancuso stated that whatever is not expressly forbidden is tacitly permitted. In this summary of the nature of convention, Mancuso highlights what I think is the main problem with our current conventions governing ministerial responsibility. The conventions are too vague and open to interpretation, and as a result, it is impossible for the convention system to effectively scrutinise government. Clearer definitions need to be made of the conventions, possibly using legislation as well, so that proper safeguards against ministerial (and departmental) incompetence and impropriety can be imposed. Once these conventions are amended, it will be much easier to make specific changes to the administration, such as creating a policy register so that blame and responsibility can be effectively administered, and changing circumstances in which ministers can avoid answering questions when subject to select committee review.

Project Based Learning for Special Education Project-based learning is an excellent way to differentiate instruction in a full inclusion classroom especially when that class includes students of widely different abilities, from the cognitively or developmental disabled to the gifted children. Project-based learning is also excellent in resource rooms or self-contained classrooms with either typically developing partners or with sufficient support or accommodations. In projects: Science: Create a model of a concept, perhaps insects, and label each part.Reading: Create a television commercial or a web page to promote a book, one you have read together or one that the group has read in a literary circle.Social Studies: Create a play, a power point presentation, or display for a State (as in Michigan,) a country, a political system (socialism, capitalism, republic, etc.) or a political point of view.Math: Plan a trip to a preferred spot (Paris, Tokyo) and create a budget for hotels, flights, meals, etc. In each case the project may support any number of educational objectives: Reinforce Content Retention Project learning has proven, in research, to improve concept retention in a range of students. Deeper Understanding When students are asked to use content knowledge, they are driven to use higher level thinking skills (Blooms Taxonomy) such as Evaluate or Create. Multi-Sensory Instruction Students, not just students with disabilities, all come with different learning styles. Some are strongly visual learners, some are auditory. Some are kinetic and learn best when they can move. Many children benefit from sensory input, and students who are ADHD or Dyslexic benefit from being able to move as they process information. Teaches Skills in Cooperation and Collaboration Future jobs will require not only higher levels of training and technical skills but also the ability to work collaboratively in groups. Groups work well when they are chosen by both the teacher and the students: some groups could be affinity-based, others could be crossability, and some could be friendship based. Alternate Means of Assessing Students' Progress Using a rubric to lay out standards can put students of varying abilities on a level playing field. Student Engagement at its Best When students are excited about what they are doing in school, they will behave better, participate more fully and benefit the most. Project-based learning is a powerful tool for the inclusive classroom. Even if a student or students spend part of their day in a resource or self-contained classroom, the time they spend in project-based collaboration will be a time when typically developing peers will model both good classroom and academic behavior. Projects can enable gifted students to push their academic and intellectual limits. Projects are acceptable across abilities when they meet the criterion established in a rubric. Project-based learning also works well with small groups of students. Let us put it this way—impressionism is painting not with the strokes of the brush but with the flow of the pen. You take minimum of words from the vocabulary and give the maximum. This style of writing is for characters, actions and scenes depicted from an objective point of view of reality. It is the test for the skill of the writer. The impressionistic style of writer takes the minimum from the dictionary (vocabulary) and gives the maximum. Experience of the writer in interpreting the various types of situations, complex, vague, transitory, permanent and subjective impressions counts much. He feels from within and the writes about them. For example, a scene can be interpreted through color or short, crisp, to the point sentences. Rapidly changing scenes, quick developments, varying scenes appropriate to the occasion, form part of impressionism. The most unexpected yet true to the subject matter, in relation to time and situation –such is the nature of impressionism. One can not read the works of such authors in a hurry. One needs to carefully examine and enjoy it sentence by sentence, sometimes word by word. Mostly, the first reading will not suffice; a second reading of such books is not an exception, but the rule. The Good Soldier†¦. The narrator in the book, John Dowell is no ordinary man. He has the spontaneous as well as cultivated ability to establish instant rapport with the characters and with the readers. He can neither be hated nor loved by the readers, and he may get as many jeers and cheers depending upon the situation. He knows how to waste, gain and the value time. He arrives and departs and ‘works’ in the book according to a time schedule known to him only. He is not a reader-puller character, but he knows how to win the confidence of the pulled reader. He is generally the know-all, knows the strengths and weaknesses of each character. He is like the stage manager in the drama, produce-director and the script writer all molded into one. He verbally sets the scenes and the time of action with matchless oratorical skill. He introduces in style, the characters and situations and sometimes indicates the morals and the convictions for which they stand and their part in the progress of the story. Once the character is introduced, he provides continuity which holds together short scenes, dialogues, and sudden and abrupt shift in the locale. With a few verbal strokes he completes his job and paves way for the interaction of the actual characters of the story. This is the type of impressionism seen in this book of Maddox, expressed through various characters. The book was first published in 1915. The century-old developments need to be noted. Lot many changes can be seen in the impressionism of the era to which the book belongs, and the impressionism adopted and followed by such writers today. The century old soldier is not the soldier of the day, as for his mental make-up and social disposition. The story has the beginning that makes you curious about what is in store for the reader as the story progresses. The beginning is dramatic. â€Å"This is the saddest story I have ever read. † The plot of the story is weaved around two couples: Edward Ashburnham and his able wife Leonora and the Americans John and Florence Dowell. The two pairs have a ‘wonderful’ level of friendship; they have spent several summers together, before World War I in Germany. Their apparently happy marriages are not that happy. Dents and fissures are seen in their relationships. So, this is the story of age-old marital conflict between the two-Him and Her! John thinks that he is too smart and polished for the talkative Florence, the one without elegance. Edward is a compulsive lady-killer-thanks to his dashing personality and his extreme sentimentalism. He compares Leonora’s charm with the one or more than one he is interested in, and they always score over Leonora. John gets the reporting of the love escapades through Leonora, after the death of the lovers. John feels extremely sorry for his lack of knowledge about human relationships and his carelessness. He turns somewhat cynical as for his lethargy in such a serious and sensitive matter. He is amazed about his carelessness. At this turn of events of the story, the narrator Dowell excels again. He gets a lovely opportunity to talk on the private lives of others. There is no guarantee that whatever he tells is truth and correct. He succeeds in kindling the curiosity of the reader. If one does the quick stock-taking of the story of this book, it is difficult to say whether it is a comedy, tragedy, the comedy of a tragedy or tragedy of a comedy or it is just satire. He condemns and eulogizes the same character, without giving any valid reasons. The private lives of the characters are divulged in regular intervals, but that is done without any offence, any grudge, without the motive of retribution and in a matter of fact of style. .Impressionism is not about creating stereo-type characters, but special, unpredictable ones. It is no ordinary mind-play. Catch and analyze the emotions threadbare. This art is difficult. Maddox has succeeded in creating a painted picture on the curtain of the minds of the reader, without actually painting, without using colors, but with the exquisite strokes of appropriate words and phrases. Notwithstanding the episodes related to sex and adultery, The Good Soldier is a book that preaches morals. The important theme of the book is the difference between reality and appearance. The difference between the actual world and the imaginary, good world! A reference was made earlier that we need to keep an important aspect in mind that it is an antic story—one hundred years old. Lots of differences exist between the values then and now. The society then did not speak about betrayal, adultery and moral confusion with ease. Now these are kindergarten stuffs. The writer of impressionism has got to be a student of psychology with capacity to peep into the minds of the characters. He doesn’t do the description of the reality, but captures the impressions thus derived. The writer is witness to the actions; he does not participate in actions or meditate between the characters. He just tries to get the impressions derived from them, penetrating their minds and piercing the hearts. Such writing is difficult to comprehend and digest. Conclusion: Considering all the above aspects The Good Soldier by Maddox, could be described as ‘impressionable’ and the significance of the novel is that its contents provide both sense of universal and spiritual. Religion and spirituality were the indivisible parts of the life of people in the nineteenth century. The novel fits into the observations of E. M Forster. He â€Å"dismisses the method of examining the novel as a historical development, in preference to an image of all novelists throughout history writing simultaneously, side by side. He first establishes that, if nothing else, a novel is a story that takes place over a period of time. He stresses the importance of character, maintaining that both ‘‘flat’’ and ‘‘round’’ characters may be included in the successful novel.
